WeWash shall have the right at any time to change or modify the terms and conditions applicable to User’s use of www.wewashsf.com , or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on www.wewashsf.com , or by electronic or conventional mail, or by any other means by which User obtains notice thereof. Any use of www.wewashsf.com by User after such notice shall be deemed to constitute acceptance by User of such changes, modifications or additions.

Thank you for visiting www.wewashsf.com and WeWash App (mobile application). By accessing and using the Website & App, you shall be deemed to have accepted to be legally bound by these Terms of Use.
The Website & App is owned and operated by WeWash. WeWash has the sole discretion to change any Term at any time. You are bound by such revisions by continuing to use or visit the Website and app after they are posted online.

Proprietary Rights

As between you and WeWash, WeWash owns all intellectual property rights, including without limitation copyright and trade-mark rights, in all materials on or comprising the Website & App (“Content”), including, without limitation, all written, audio visual or other materials and graphical elements on the Website & App, but excluding User Content (defined below in Section 3).
User Content & Privacy
1. You may be able to post or upload (in designated areas of the Website & App) written Content or other Content (collectively “User Content”). You are solely responsible for your own User Content and the consequences of posting or publishing it. By uploading or posting User Content to the Website, you automatically grant WeWash a worldwide, non-exclusive, royalty free, license to use, reproduce, modify, translate into different languages or formats, and publish such User Content on the Website for the purpose of sharing the User Content with users and visitors of the Website and to promote the Website. You represent and warrant that you own or have the rights to use and license WeWash to use the User Content in the manner contemplated by the Website & App and these Terms.
2. Your use of the web site is subject to WeWash’s Privacy Policy.
Restrictions on Use of Materials

Except as otherwise provided, the Content of this Website shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without the prior written permission of WeWash. Modification of any of the Content or use of the Content for any other purpose will be a violation of WeWash’s copyright and other intellectual property rights. Graphics and IMG on this Website are protected by copyright and may not be reproduced or appropriated in any manner without written permission of WeWash.
Disclaimer of Warranties and Liability
1. While WeWash has made every reasonable effort to ensure that the information contained in the Website have been obtained from reliable sources, WeWash provides the Content and information on the Website & App on an “as is” basis without warranty of any kind. To the fullest extent permitted by law, WeWash does not warrant and hereby disclaims any warranty:
  - as to the accuracy, correctness, reliability, timeliness, non-infringement, title, merchantability or fitness for any particular purpose of the Content of the Website & App;
  - that the Content available through this Website or any functions associated therewith will be uninterrupted or error-free, or that defects will be corrected or that this Website and the server is and will be free of all viruses and/or other harmful elements.
2. WeWash shall also not be liable for any damage or loss of any kind caused as a result (direct or indirect) of the use of the Website & App, including but not limited to any damage or loss suffered as a result of reliance on the Content contained in or available from the Website & App.

Third party Content may appear on the Website & App or may be accessible via links from the Website & App. WeWash shall not be responsible and assumes no liability for any infringement, mistakes, misstatements of law, defamation, libel, slander, omissions, falsehood or profanity in the statements, opinions, representations or any other form of Content contained in any third party Content appearing on the Website & App. Please be aware that the information and opinions in the third party Content are neither endorsed by nor do they reflect the belief of WeWash.
Right of Access

WeWash reserves all rights to deny or restrict access to the Websites to any particular person, or to block access from a particular Internet address to the Websites, at any time, without ascribing any reasons whatsoever.
You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Websites, use any robot, spider, other automatic device, or manual process to monitor or copy any pages within the Websites or the Content without WeWash’s prior written permission, and take any action that imposes a disproportionately large or unreasonable load on WeWash’s servers.
Governing Law

The Website is operated by WeWash from its offices within the United States and elsewhere around the world. It can be accessed from all countries around the world where the technology permits. However, by accessing the Website, you agree that all access and use of the Website & App and the Content, and the Terms of Use shall be governed by, and construed in accordance with, the laws of the United States. You hereby agree to submit to the non-exclusive jurisdiction of the United States courts.

Payments

As a Vehicle Owner, you agree that any amounts charged following a wash (a “Charge”) are mandatory and due and payable immediately upon the order of the Service on the WeWash Platform completion. Total charges include Service Fees and taxes, plus any tips to the Service Provider that you elect to pay. WeWash has the authority and reserves the right to determine and modify pricing by posting applicable Charges to its website. Charges may vary based on the type of service you request as described on the WeWash website. You are responsible for reviewing the WeWash website and shall be responsible for all Charges incurred under your User account regardless of your awareness of such Charges or the amounts thereof. In all markets, Charges are subject to maximum limits as set forth on the WeWash website.

Service Fees. Service Fees consist of a base price and incremental charges based on additional services requested.
Facilitation of Payments. All Charges are facilitated through a third-party payment processing service (e.g., Stripe, Inc., or Braintree, a division of PayPal, Inc.). WeWash may replace its third-party payment processing services without notice to you. Charges shall only be made through the WeWash Platform. Cash payments are strictly prohibited.
Refunds. Charges are assessed immediately on placing the Service order on the WeWash Platform following to your authorized payment method. All Charges are non-refundable. This no-refund policy shall apply at all times regardless of your decision to terminate usage of the WeWash Platform, any disruption to the WeWash Platform or Services, or any other reason whatsoever.
Promotions. WeWash, at its sole discretion, may make available promotions with different features to any of our Vehicle Owners or prospective Vehicle Owners. These promotions, unless made to you, shall have no bearing whatsoever on your Agreement or relationship with WeWash.
Credit Card Authorization. Upon addition of a new payment method or each service request, WeWash may seek authorization of your selected payment method to verify your payment method, ensure the service cost will be covered, and protect against unauthorized behavior. The authorization is not a charge; however, it may reduce your available credit by the authorization amount until your bank’s next processing cycle. Should the amount of our authorization exceed the total funds on deposit in your account, you may be subject to overdraft of NSF charges by the bank issuing your debit or check card. We cannot be held responsible for these charges and are unable to assist you in recovering them from your issuing bank.

As a Service Provider, you will receive applicable Service Fees (net of WeWash’s Administrative Fee, as discussed below) and any tips provided by Vehicle Owners to you for the Services you provide. WeWash will process all payments due to you through its third party payments processor. You acknowledge and agree that such amounts shall not include any interest and will be net of any amounts that we are required to withhold by law. You expressly authorize WeWash to set the prices on your behalf for all Charges that apply to the provision of Services. WeWash reserves the right to withhold all or a portion of Service Fees if it believes that you have attempted to defraud or abuse WeWash or WeWash’s payment systems.

In exchange for permitting you to offer your Services through the WeWash Platform and marketplace as a Service Provider, you agree to pay WeWash (and permit WeWash to retain) a fee based on each transaction in which you provide Services (the “Administrative Fee”). The amount of the applicable Administrative Fee will be communicated to you in an Administrative Fee schedule. WeWash reserves the right to change the Administrative Fee at any time in WeWash’s discretion based upon local market factors, and WeWash will provide you with notice in the event of such change. Continued use of the WeWash Platform after any such change in the Administrative Fee calculation shall constitute your consent to such change.

WeWash, at its sole discretion, may make available promotions with different features to any Service Providers or prospective Service Providers. These promotions, unless made to you, shall have no bearing whatsoever on your Agreement or relationship with WeWash.

Services
1. This service is meant for customer’s purchase of WeWash Car Wash Services.
2. WeWash is not liable for any loss or damages including any damages or scratches to your vehicle or loss of your possession.
3. No harmful chemicals will be used on your vehicle.
4. Cleaning will be done on your vehicle’s exterior body and rims using our tools and clean microfiber cloths.
5. The Company reserves the right to cancel the car wash services for any reason. In these circumstances, the Company will refund any monies paid by you for the period for which our services is not provided
Customer’s Responsibilities
1. Customers must produce Vehicle registration card/ or other documents of title for verification when requested.
2. Your vehicle must be parked within your estate’s allocated car park(s) for washing to be conducted on the scheduled day. We advise to park your vehicle in a sheltered area on wash day for wash to be carried out even on rainy days.

4. You may not at any time solicit any employee of the Company to terminate their relationship with the Company or for any other work (whether in relation to the scope of the work of the Company).
5. Please email a feedback to us via our website for any complaints or compliments.
6. Our employees’ bonuses are greatly dependent on your feedback.
7. We will do our best to ensure that a good job is done.
Payment
1. Ensure that you have selected the right package and choice payment mode.
2. If you do not receive your confirmation invoice receipt within 2 working days after the transaction, please forward the following information: your name, vehicle registration number, address and your contact number to contact@wewashsf.com.
3. All payment made are non-refundable.
4. We accept Debit/Credit card payments online.
5. Without prejudice to all its rights, WeWash may at its discretion, require you to pay the differences in subscription charges including an administrative fee, if it is found that any information provided by you in the Application for Car Wash Services or other relevant document is false or incorrect.
6. WeWash will issue receipt for payment of car wash services using this e-application or app.
7. WeWash reserves the right to change/amend the terms and conditions from time to time.

* Best Effort Basis: Our services are provided on a best efforts basis – we will not be held responsible in the event that we are unable to clean, remove stains, or otherwise restore any surface, fabric, or condition on your vehicle. All services listed in our marketing material are for reference only, and do necessarily represent a guarantee that the service was performed depending upon the condition of your vehicle or upon a special extenuating circumstance.

** Incidental Damage: We are not responsible for any incidental damage that may occur while your vehicle is in our possession, including but not limited to any damage related to pre‐existing conditions (tears, scratches, dents, stains, odors, etc.) damage to automated windshield wiper systems, wiper blades, rear window wipers, loose interior trim or exterior moldings, exterior mirrors, trailer hitch caps, roof racks, power antennas, insignias, aftermarket accessories (bug shields, sun visors), magnetic signage, running boards, hood ornaments, or alloy, chrome or mag wheels, headlights, rear lamps, or reflectors.

We will be responsible for anything we break or damage in the course of providing our service, so long as the damage did not involve a prior condition.
